Electricity Works above 110kV and 100MVA on Roads and Level Crossings
Sections 24 and 31 of the Electricity Act 1992 were amended with effect from 9 August 2005. The amendments remove a potential barrier to the timely development of electricity infrastructure, by extending the statutory rights of electricity operators in respect of access to roads and level crossings. The amendments provide electricity operators with a statutory right of access to, among other things, open or break up a road to construct high voltage works in the ground below a road or suspend them in the air above a road (for example, from poles or towers outside the road reserve), subject to reasonable conditions prescribed by the relevant controlling authority and the owner of the pipe, telecommunications line, or works, as the case may require.
A discussion paper on this topic was released on 3 September 2004 with submissions closing on 24 September 2004. The resulting decisions and a summary of submissions were released on 2 December 2004.
