Electricity Operator Status
Pursuant to section 4 of the Electricity Act 1992, the Minister of Energy may declare by notice in the Gazette, electricity operator status. Before making a declaration under section 4, the Minister has to be satisfied that a declaration is necessary to enable the person to commence or carry on a business as an electricity distributor.
Persons who are "declared" to be electricity operators under section 4 of the Act may have one or more of the following powers conferred on them:
- rights of entry to roads (other than motorways), to construct and maintain fittings (section 24 of the Electricity Act 1992);
- rights of entry to level crossings, to construct and maintain fittings (section 31 of the Electricity Act 1992); and
- rights of entry to private land to complete "existing works" or "fittings" where work had commenced prior to January 1993 (section 23 of the Electricity Act 1992).
