Personal Property Securities Registration


The Personal Property Securities Act (PPSA) was passed in 1999, and came into force on 1 May 2002. The Personal Property Securities Regulations and Register took effect at the same time.

The PPSA implemented a number of changes to the law relating to security interests over personal property including:

  • a common set of rules to establish priority of security interests in personal property;
  • a single procedure for the creation and registration of security interests in such property; and
  • a centralised, electronic Personal Property Securities Register (PPSR).

Personal Property Securities Register

The Personal Property Securities Register became operational on 1 May 2002. It replaces four separate registries: the motor vehicle securities register, the chattels register at the High Court, and the registers of company charges and industrial and provident society charges at the Companies Office. Security interests over almost all types of personal property, other than land and ships, can now be registered in one place.

Within the Ministry

The Regulatory and Competition Policy Branch is responsible for the development of policy relating to Personal Property Securities, while the Business Services Branch is responsible for operating the Register.
