*Notice to parties to investigation - Section 10a (1) of the Dumping and Countervailing Duties Act 1988 ("the Act") provides that subject to subsection (2) of this section, within 150 days after the initiation of an investigation under section 10 of this Act, the Chief Executive shall give to the parties to the investigation referred to in section 9(b) of this Act written advice of the essential facts and conclusions that will likely form the basis for any final determination to be made under section 13 of this Act.

Minister's Decision

The Minister of Commerce was satisfied that the goods were being dumped, but had not caused material injury to the New Zealand industry, but that material injury was being threatened.

Summary of the Investigation

Background

Based on an application from the New Zealand industry, the Ministry of Economic Development initiated a dumping investigation on 1 October 2004. It alleged that Oral Liquid Paracetamol from the Republic of Ireland was being imported at dumped prices and that this was causing material injury to the New Zealand industry.

The investigation concluded that:

  • most of the goods under investigation are being dumped;
  • material injury to the New Zealand industry has been caused to the New Zealand industry by factors other than the dumped goods; and that
  • material injury to the New Zealand industry is threatened by the dumped goods.

On 30 March 2005 the Minister of Commerce made a final determination that the goods were dumped and were threatening to cause material injury to the New Zealand industry. The Minister decided to defer the decision on the imposition of anti-dumping duties, pending review following the outcome of the current PHARMAC tender process, or any other event that changes the market supply situation.
