*The Ministry's normal practice for new shipper reassessments is to set the effective date of any change to the rate or amount of countervailing duty as the date of initiation of the reassessment itself.  This practice has been followed in this case.

Summary of Reassessment

The reassessment concluded that:

  • imports of canned peaches into New Zealand from Venus Growers are subsidised,

and therefore

  • countervailing duties on canned peaches imported or intended to be imported into New Zealand, and supplied by Venus Growers of Veria, Greece, should be reassessed to reflect the rate of injurious subsidisation.

The Ministry also considered whether it was necessary, as a result of this reassessment to reassess the generic rate of countervailing duty applicable to Greek canned peach suppliers other than those specified in the relevant schedule of countervailing duty rates.  It was determined that this was not necessary and that the "generic rate" should remain unchanged.

Likewise, the Ministry considered whether it was necessary to reassess the generic rate of countervailing duty applicable to EU canned peach suppliers other than those specified in the relevant schedule of countervailing duty rates.  It was determined that this was not necessary and that the "generic rate" should remain unchanged.

Reassessment of Countervailing Duties

The reassessed rate of countervailing duty applicable to Venus Growers has been incorporated into the overall schedule of countervailing  duty rates applicable to canned peaches from the member states of the European Union.  The schedule forms part of the NZCS instruction relating to these goods which is available as shown below.
