** Notice to parties to investigation(1) Subject to subsection (2) of this section, within 150 days after the initiation of an investigation under section 10 of this Act, the Secretary shall give to the parties to the investigation referred to in section 9(b) of this Act written advice of the essential facts and conclusions that will likely form the basis for any final determination to be made under section 13 of this Act.
The requirement to provide essential facts and conclusions to interested parties does not apply to review investigations, however the Ministry attempts as far as possible to follow normal investigative procedures and an interim report in the format of an extract from the draft final report was provided to all known interested parties in sufficient time for comments to be considered and incorporated into the Final Report.
Summary of Conclusions
Anti-dumping duties were imposed on certain oil filters from the United States in November 1992. A full review and reasessment was completed in April 1996 and a seperate reassessment in July 1994. A further review of the necessity for the continued imposition of anti-dumping duties on these goods has now been completed.
Based on the information made available during the review, the has Ministry concluded that;
- Some oil filters imported into New Zealand from the US during the review period (1 June 1999 to 31 May 2000) had been dumped.
- The proportion of oil filters that had been dumped has reduced over the period since the last review in 1996, and the volume of dumped goods had declined significantly.
- A number of other factors are impacting on the New Zealand industry and market.
- No current material injury is attributable to dumped imports from the United States.
Whilst dumping had continued, there was no positive evidence that demonstrated that the removal of anti-dumping duties would be likely to bring about a recurrence of material injury to the New Zealand industry.

Termination of Anti-Dumping Duties
Given the conclusions reached in the review, the Chief Executive of the Ministry of Economic Development recommended to the Minister of Commerce that he terminate the existing anti-dumping duties with effect from 15 December 2000 being the completion date of the review.
On 20 December 2000 the Minister accepted the recommendation to terminate the anti-dumping duties.
