    ** Notice to parties to investigation—(1) Subject to subsection (2) of this section, within 150 days after the initiation of an investigation under section 10 of this Act, the Secretary shall give to the parties to the investigation referred to in section 9(b) of this Act written advice of the essential facts and conclusions that will likely form the basis for any final determination to be made under section 13 of this Act.

    Minister's Decision

    The Minister determined that although the goods were being dumped, material injury to a New Zealand industry had not been caused.

    Summary of The Investigation

    Background

    This investigation related to PHARMAC’s (the New Zealand Government’s Pharmaceutical Management Agency) tender of a generic pharmaceutical for sole subsidised supply of the New Zealand market for a period of two and a half years.

    Summary of Investigation Findings

    The investigation concluded that:

    • some of the Tamoxifen originating from the United Kingdom and imported into New Zealand has been dumped; and
    • material injury to the New Zealand industry has been or is occurring; but it has not been demonstrated that dumping is a cause of material injury.

    On 21 February 2001 the Minister of Commerce made a negative final determination that the goods under investigation were dumped, but that material injury to the New Zealand industry had not been caused by reason of the subject goods being dumped.
