Summary of Decisions:

Having been advised in October 1999 that the sole New Zealand producer of sweetened condensed milk had ceased production, the Ministry carried out an inquiry to ascertain whether a New Zealand industry continued to exist.

Based on the information made available during the inquiry, it was concluded that there was no longer an industry in New Zealand to which injury could be caused or threatened by dumped imports of sweetened condensed milk from Thailand.

Consequently, a report was provided to the Minister of Commerce recommending that the anti-dumping duties be revoked.

Revocation of Anti-Dumping Duties:

On 1 February 2000 the Ministry's recommendation was agreed to by the Acting Minister of Commerce and the anti-dumping duties revoked with effect from 14 July 1999 being the date on which the New Zealand industry ceased to produce sweetened condensed milk.

Any anti-dumping duties paid on shipments imported since that date will be refunded.
