Summary of Factors Leading To Initiation

Background

This was a third country dumping investigation.  The application was lodged by the Australian Government on behalf of the Australian industry producing like goods.   There is no New Zealand producer of these goods therefore the investigation is in response to allegations by the Australian industry that subject goods, dumped into the New Zealand market are causing them material injury.

Dumping

The information contained within the application provided sufficient evidence of dumping, with margins of between 18 and 26 percent.

Material Injury

The application which was received provided sufficient evidence of likely material injury in the form of price undercutting, price depression and suppression, and a consequent economic impact in the form of a decline in profitability that could be attributed to dumping.

No evidence was provided of an actual decline in output, market share, sales volume or revenue due to dumping, however, the evidence does indicate a potential decline in both sales volume and market share.

Factors other than dumping may have contributed to the alleged injury. 

The purpose of the investigation was to establish whether the subject goods are dumped, and if so, whether they are causing or threatening to cause material injury to the Australian industry.

Summary of Factors Leading To Termination

The investigation was terminated in terms of section 11 of the Dumping and Countervailing Duties Act 1988 due to the withdrawal of the application by the Australian producer by or on behalf of whom the application was made.  Further details of the termination are contained in the Ministry's Termination Memorandum which is available from this site.
