Summary of Anti-Dumping Investigation: ACE Inhibitors From Germany and Switzerland

Angiotensin converting enzyme (ACE) inhibitors made with the active ingredient cilazapril or quinapril, other than combination ACE inhibitors

Countries of Origin:

Germany and Switzerland

History of Determination:

Initiated:8 April 1999
Termination:30 August 1999

Introduction:

Merck Sharp & Dohme (Australia) Pty Ltd, part of the Australian industry, alleged that ace inhibitors from Germany and Switzerland were threatening to cause material injury.  Another Australian producer, Bristol Meyers Squibb (Australia) Pty Ltd, also supported the application.

Anti-dumping Duty:

Not applicable - Investigation terminated

Overview

The investigation was terminated by the Minister for Enterprise and Commerce pursuant to section 11(1) of the Dumping and Countervailing Duties Act. This provides that the Minister shall terminate an investigation if he is satisfied that:

(a)    The application for the investigation has been withdrawn in writing by those Australian producers by or on whose behalf the application was made; or

(b)    Australian producers who previously expressed support for the application for the investigation have withdrawn that support to such an extent that the "standing" requirements for initiation could no longer be met.

The Minister terminated the investigation because the application was withdrawn in writing by Merck Sharp & Dohme (Australia) Pty Ltd and Bristol Meyers Squibb (Australia) Pty Ltd.
