Section 14(9) "Sunset" Date

(Date on which anti-dumping duties will cease to apply unless a review has been initiated prior to the date specified.)

A reassessment of duties is in progress and the "sunset" date will be five years from the date of notice of reassessment of the duties.

Anti-Dumping Duty

Following the completion of the review, a reassessment of anti-dumping duties was initiated. Current anti-dumping duties continue to apply pending the outcome of the reassessment. If the reassessment results in anti-dumping duties that are lower than the current anti-dumping duties, the Minister of Commerce, under section 14(10) of the Dumping and Countervailing Duties Act 1988, may require the New Zealand Customs Service to refund, with effect from 30 July 2001, the date of the initiation of the review, the difference between the duty paid and the lower duty. If the reassessment results in duties higher than the current anti-dumping duties, the new duty will be payable from the day after the date the Minister makes his determination on the reassessments.
