The Memorandum of Understanding (MoU) on business law co-ordination with Australia [link to MFAT website] is being reviewed.
The MoU was signed in 2000 and was due for a review after five years. The Australian and New Zealand governments have agreed on Terms of Reference for the review.
As noted in the Terms of Reference, the 2005 review of the MoU is an opportunity to both review the work programme and, in addition, identify any areas where the MoU might be strengthened.
We are seeking contributions to the review and comments on how effective the MoU has been and how it could be changed to enhance future business law coordination. In particular, we seek views on the following questions:
- Do you think the principles espoused in the MoU are still valid, or how could they be updated?
- Are there any developments which have occurred over the last five years that may impact on the MoU, apart from those mentioned in the terms of reference?
- What areas do you think should be the focus of the business law coordination work programme over the next five years? You may wish to consider initiatives in the areas of regulatory coordination, cooperation between bodies administering regulation, and other ways of reducing transaction and compliance costs for businesses operating on a trans-Tasman basis.
