Introduction
The Agreement on Trade-Related Aspects of Intellectual Property Rights (the TRIPS Agreement) was concluded in 1994 and forms Annex 1C of the Agreement Establishing the World Trade Organisation (WTO). TRIPS sets minimum standards on the protection of intellectual property rights to which Members of the WTO are required to adhere. TRIPS does not prescribe how Members are to implement the requirements of the Agreement. Members are free to determine the appropriate method of implementing the provisions of the Agreement within their own legal system and practice.
New Zealand is a party to the Paris Convention for the Protection of Industrial Property 1883 and, as a WTO Member, the TRIPS Agreement. New Zealand's intellectual property framework complies with all of our obligations under the TRIPS Agreement.
