Minister's Decision

The Minister of Commerce was satisfied that although the goods were being dumped, there was insufficient evidence that material injury to a New Zealand industry was being threatened.

Summary of the Investigation

Background

Based on an application from the New Zealand industry, the Ministry of Economic Development initiated a dumping investigation on the 6 June 2003. It alleged that Portland cement from Thailand was being imported at dumped prices and that this was threatening to cause material injury to the New Zealand industry in the near future.

Conclusions

The investigation concluded that:

  • the goods under investigation are being dumped.
  • Any injury threatening the industry is not considered to be material nor is it clearly foreseen or imminent that material injury will arise as a result of the dumped goods.
  • Section 11 of the Act provides that where the Minister is satisfied that there is insufficient evidence that material injury is being threatened by means of dumped goods, the Minister shall terminate the investigation with respect to those goods.

On 30 November 2003 the Minister of Commerce terminated the investigation, as there was insufficient evidence that the dumped goods threatened to cause material injury to the New Zealand industry.

1Notice to parties to investigation - Section 10A (1) of the Dumping and Countervailing Duties Act 1988 ("the Act") provides that subject to subsection (2) of this section, within 150 days after the initiation of an investigation under section 10 of this Act, the Chief Executive shall give to the parties to the investigation referred to in section 9(b) of this Act written advice of the essential facts and conclusions that will likely form the basis for any final determination to be made under section 13 of this Act.
