Short Description
Information on the development of levy regulations to recover the costs of the Commerce Commission in performing its functions, powers and duties under Part 4 of the Commerce Act
A new Part 4 was added to the Commerce Act 1986 in October 2008. The new Part 4 puts in place a revised regulatory regime for electricity lines businesses (including Transpower), gas pipelines and major international airports, replacing the old Parts 4 and 4A and sections of Part 5 of the Commerce Act.
Section 53ZE of the Commerce Act provides for levy regulations to recover from every supplier of regulated goods or services the costs of the Commerce Commission in performing its functions, powers and duties under Part 4.
As part of the implementation of the new Part 4, new levy regulations were required to replace the existing electricity and gas sector levy regulations and to cover additional regulated gas pipeline businesses and international airports. Options for the levy design were outlined in a discussion paper that was put out for consultation in October 2008. Following consideration of submissions, the preferred levy design option was presented to Cabinet in April 2009 and agreed to. The new regulations, called the Commerce (Levy on Suppliers of Regulated Goods and Services) Regulations 2009, have now been made and come into force on 19 June 2009. The regulations are available on the New Zealand Legislation website www.legislation.govt.nz.
Funding the Regulation of Electricity, Gas and Airports Sectors under the revised Commerce Act 1986 – Discussion paper
This discussion paper proposes options for levy design for the revised regulatory regime under Part 4 of the Commerce Act, and seeks the views of electricity lines businesses, gas pipeline businesses, major international airports and other interested stakeholders on their preferred options.
