Auctioneers Act Review: Discussion Document 2000

The Ministry of Economic Development is currently reviewing the Auctioneers Act 1928. This discussion document is part of an information gathering exercise, and its purpose is to obtain informed responses from industry and other interested parties on matters concerning the Act. The responses will be used to aid the Ministry in formulating advice to be given to Ministers on possible changes to the current regulatory regime for auctioneers.

This paper begins by describing the broad framework for occupational regulation. It then describes a number of problems, or potential problems, with the content and operation of the Act that have been identified by stakeholders in the auctioneering industry. A number of questions are asked of the reader throughout the paper. Note that the options put forward for discussion are not necessarily the preferred options of the Ministry of Economic Development. The opinions and options outlined in this paper do not represent Government policy.

Each section of the paper is designed to be mutually exclusive; they do not follow a sequential ordering. To highlight this point, the second section focuses on the question of whether the licensing regime should continue. Other parts of the paper then put forward a number of questions for consideration that are based on the assumption that the licensing regime will remain in place. This should not be interpreted as the Ministry necessarily favouring the continuation of the licensing requirement. The paper was structured in this manner because it was considered that it would be the best way of provoking the readers' consideration of a wide range of issues.

The Ministry of Justice, The Ministry of Consumer Affairs, the Treasury, the Department for Courts, and the Police have been consulted in preparing this paper.

Note that you may respond to as many or few of the questions or discussion points contained in the paper as you consider appropriate. The Ministry would also be interested in hearing of any other options that you consider may be more appropriate than those contained in this paper.
