7. WIPO
New Zealand copyright law should be framed in such a manner that it ensures the appropriate balance between the rights of copyright owners and copyright users is maintained, for the benefit of New Zealand society as a whole. It is therefore of concern that the WIPO Internet treaty appears to favour the rights of copyright owners at the expense of users of the copyright works.
The NZVCC supports the Ministry's recommendations15 that the national interest be the principal factor in shaping any legislative change, whilst gradually enabling New Zealand's compliance with the relevant aspects of the WIPO Internet treaties.
It is noted that there are difficulties for copyright owners and users in negotiating licences for digital material. If more restrictive copying provisions are introduced into the Act this will impact on the fees educational institutions have to pay for their copyright licences.
