LIANZA agrees with the approach taken by the Ministry in Part Four of the Position Paper. In particular,
LIANZA supports the exclusion of
ISPs from some liability (paragraph 80),particularly for organisations which are not generally considered to be
ISPs such as educational institutions and libraries (paragraph 82).
LIANZA considers that providing an exception from liability for transient copying, as supported in paragraph
(11) of this Submission, will cover
ISPs (paragraph 83).
LIANZA also supports the recommendation (paragraph 86) that the Act should provide an exception for caching; and the proposals (paragraphs 89-93) regarding secondary infringement.
