(11) LIANZA agrees with paragraph 37 that the existing definition of copying ("reproducing or recording the work in any material form") is technologically-neutral. However, in view of the need for greater clarity and transparency referred to in paragraph 30 of the Position Paper, LIANZA considers that the definition of copying should be amended specifically to include digital formats, as suggested in paragraph 39. LIANZA also recommends that the definition of copying should specifically cover the conversion of a work from one format (print, video, etc) into digital form.
Transient Copying
(12) LIANZA believes that it is essential for transient copying to be excluded in some way from the definition of copying, so that it does not fall within the "acts restricted by copyright" (Section 16 of the Act), It is difficult to see how incidental copying that occurs purely as a consequence of the technical processes of a computer system would damage copyright owners' interests, particularly where the copies made are temporary. Adoption of the Australian wording, given in paragraph 50, would appear to achieve what is required.
