59. All Cabinet and Committee papers are required to contain a section entitled Regulatory Impact Analysis. This section is needed regardless of whether the RIA requirements apply of whether the RIAU reviews the RIA analysis and RIS. The Regulatory Impact Analysis section must state:

  • whether the department confirms that the principles of the Code of Good Regulatory Practice and the regulatory impact analysis requirements, including the consultation RIA requirements, have been complied with (the Code is explained more in paragraph 9);
  • whether a RIS has been prepared, whether the RIAU considers the RIS is adequate (or, if the RIS is not reviewed by the RIAU, whether the department considers it is adequate), and if a RIS has not been prepared, why not; and
  • whether the RIS was circulated with the Cabinet paper for departmental consultation.

60. If the analysis and/or the RIS are inadequate, the statement should indicate the ways in which they are inadequate. Note that the RIA will determine adequacy if the proposal is likely to have a "significant impact on economic growth"; departments will assess adequacy for other proposals.

"The Department of Labour confirms that the principles of the Code of Good Regulatory Practice and the regulatory impact analysis requirements, including the consultation RIA requirements, have been complied with. A RIS was prepared and the Department of Labour considers it to be adequate. The final RIS was circulated with the Cabinet paper for departmental consultation."


61. For proposals that are likely to have a "significant impact on economic growth", the RIAU will provide a comment on whether the analysis and the RIS are adequate, for insertion into the RIS and Cabinet paper. If the analysis and/or the RIS are inadequate, the statement will indicate the ways in which they are inadequate.
