O1. Advice received is that criminal penalties, including fines or imprisonment, may be imposed on those who supply infringing goods in the course of commerce and on those who import and export such goods. This is not only limited to infringement of copyright and trade marks, but extends to infringement of any protected intellectual property right.
O2. There is a maximum term of five years imprisonment. German law also provides for confiscation and destruction of infringing goods.
O3. There are border measures against importation of counterfeit trade mark or pirated copyright goods.
