38. The question of access to, and use of, New Zealand's indigenous genetic resources is being dealt with in the development of the New Zealand Biodiversity Strategy. As part of this Strategy, the government is developing a bioprospecting policy. Public input into the development of the bioprospecting policy was sought through a discussion paper released in November 2002. Further input will be sought throughout the policy development process.

39. One of the objectives of the bioprospecting policy is that the policy should facilitate responsible access to biological resources, with prior informed consent of the owners/managers of the resources on mutually agreed terms. The development of the bioprospecting policy may require amendments to the PVRA to achieve this objective.
