Commerce Commission Unbundling Investigation
On 22 December 2003 the Minister of Communications, Hon Paul Swain, received the final report of the Commerce Commission on the Section 64 Review and Schedule 3 Investigation into Unbundling the Local Loop Network and the Fixed Public Data Network.
Under Section 64 of the Telecommunications Act 2001 the Commission was required to investigate whether or not each of the following services should be regulated:
- Access to the unbundled elements of Telecom's local loop network; and
- Access to the unbundled elements of, and interconnection with, Telecom's fixed Public Data Network.
The Commission commenced its investigations on 10 April 2003 with the publication of an Issues Paper. On 4 September 2003 the Commission commenced an additional investigation under Schedule 3 of the Act into certain aspects of unbundling. The Commission published its draft report on both investigations on 18 September 2003. On 14 October 2003, the Commission released an amended draft report to include amendments to certain input figures in the cost-benefit analysis.

Ministerial Decision on Commerce Commission Final Report
On 23 December 2003 the Minister of Communications stated that he would accept written comments on "any new matters raised in the report that were not the subject of previous submissions to the Commission, and on any other relevant matters not addressed in the report." These submissions were due on 9 February 2004. Cross-submissions on these documents were due to the Minister of Communications by 1 March 2004. The Minister announced his decision to accept the Commerce Commission's recommendations on 19 May 2004. The Minister has released official papers including Ministry advice and relevant Cabinet papers related to this decision.
