Commerce Commission Investigation
On 9 June 2005 the Minister of Communications, Hon David Cunliffe, received the final report of the Commerce Commission on the Telecommunications Act 2001 Schedule 3 Investigation into Regulation of Mobile Termination.
The Commission decided to investigate the need for regulation of mobile termination in May 2004 after considering complaints that a lack of competition in the mobile termination market resulted in charges for fixed-to-mobile calls in New Zealand that were unreasonably high. Mobile termination rates are the fees mobile phone companies charge other carriers to terminate calls on their networks and are a significant input cost in providing the retail services of fixed-to-mobile and mobile-to-mobile calls.
The report recommends that the termination of fixed line voice calls on cellular telephone networks (excluding third generation cellular networks) should be regulated. Copies of the report are available from the Commerce Commission (see Documents below).
Ministerial Decision
Under the Telecommunications Act 2001 the Minister may accept the Commission's recommendation, reject the Commission's recommendation, or request the Commission to reconsider its recommendation.
Prior to making a decision the Minister sought comments on any new matters from interested parties by 1 July 2005 and advice from officials. Copies of comments received were published on this website on 7 July 2005.
On 9 August 2005 the Minister requested the Commerce Commission to reconsider the following aspects of its recommendation:
- give further consideration to the definitional and implementation issues concerning 2G and 3G;
- consider the commercial offers made by Telecom and Vodafone following the Commission’s final report, in comparison to regulation;
- give further consideration to how best to ensure that end-users benefit from reductions in wholesale mobile termination rates.

Commerce Commission Reconsideration
On 21 April 2006, the Minister received the Commission's reconsideration final report on the Schedule 3 Investigation into Regulation of Mobile Termination.
The Commission recommends regulation of the termination of voice calls made from fixed home or business phone lines to all mobile networks, including those using 3G technologies.
Ministerial Decision
Under the Telecommunications Act 2001 the Minister may accept the Commission's reconsidered recommendation, reject the Commission's reconsidered recommendation, or request the Commission to reconsider again its recommendation.
The Minister sought comments on any new matters from interested parties by 22 May 2006. Copies of comments received were published on this website on 29 May 2006.
