The Ministry is currently investigating the effectiveness of enforcement of the criminal offences and how enforcement may be improved. It has proposed that enforcement efforts by government agencies of the criminal offences would be improved by making the Ministry's National Enforcement Unit responsible for enforcement of the criminal offences.

  This paper seeks Cabinet agreement to amend the Trade Marks Act and Copyright Act to give the National Enforcement Unit the powers necessary to enforce the criminal offences for manufacturing, importing and selling counterfeited goods and pirated works.
