Information Sharing by the Commerce Commission
In 2003, CER Ministers from Australia and New Zealand agreed to explore ways of improving the integration of our competition and consumer protection regimes and seek to coordinate more closely in their development. To this end, they endorsed a joint work programme for greater co-ordination of competition law, policy and enforcement under the Memorandum of Understanding on Business Law Harmonisation. Included in the work was increased information sharing between the respective competition authorities.
This review forms part of this joint work programme. It will consider:
- arrangements for information sharing by and within the Commission;
- arrangements for information sharing by the Commission with other enforcement agencies both within New Zealand and overseas;
- whether to allow the Commission to enter into arrangements with other enforcement agencies for the sharing of commercially sensitive information, subject to appropriate safeguards; and
- issues relating to the provision of investigative assistance to overseas competition authorities.
On 16 September 2004, the Minister of Commerce released a Discussion Paper for consultation on this issue. Responses were due by 9 November 2004.
