Review of the Plant Variety Rights Act 1987
Since the Plant Variety Rights Act 1987 was passed, there have been significant advances in plant breeding techniques. There have also been international developments. In 1991, UPOV member states negotiated a revised version of the UPOV Convention (UPOV 91) which New Zealand has not ratified. In light of these developments, the Plant Variety Rights Act 1987 has been reviewed to determine whether the Act provides adequate protection for new plant varieties.
Public input to this review was sought through a discussion document "Review of the Plant Variety Rights Act 1987 " released in March 2002. Submissions closed on 26 July 2002, and a summary of submissions was released in November 2002. Cabinet agreed to policy proposals arising from the review on 28 July 2003.
